These Terms of Service ("Terms") govern your access to and use of BrainSharp 50+, operated by Advanced Learning Academy LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

BrainSharp 50+ is a subscription-based cognitive training platform designed for adults aged 50 and older. The Service provides brain training exercises, assessments, progress tracking, and educational content targeting six cognitive domains: Memory Recall, Processing Speed, Attention & Focus, Reasoning & Logic, Word Retrieval, and Spatial Processing.

Medical Disclaimer: BrainSharp 50+ is a fitness and educational tool, not a medical device or treatment. It does not diagnose, treat, cure, or prevent any disease or medical condition, including Alzheimer's disease or other forms of dementia. Results vary by individual. Consult your physician before beginning any new cognitive or fitness program.

To use BrainSharp 50+, you must:

• Be at least 18 years of age (the Service is designed for adults 50+).
• Provide accurate, current, and complete registration information.
• Have the legal capacity to enter into a binding contract.
• Not be prohibited from using the Service under applicable law.

Subscription Fee: The Service is available for $24.95 per month per account.

Billing: Your subscription is billed monthly to your payment method on file. Billing begins on the date you subscribe and recurs on the same day each month.

Cancellation: You may cancel your subscription at any time through your Account settings or by contacting us at team@advancedlearning.academy. Cancellation takes effect at the end of your current billing period. You will not receive a prorated refund for unused days in a billing period unless required by applicable law.

Free Trial: If we offer a free trial period, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends.

Price Changes: We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price increase. Your continued use of the Service after the effective date constitutes acceptance of the new price.

Partner Access: Eligible subscription tiers may include the ability to add a partner or family member to your account. Partner access is subject to the same Terms and tied to the primary account holder's subscription.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account at team@advancedlearning.academy.
• Keeping your contact and billing information current.

You may not share your login credentials with others outside of any partner access features explicitly provided by the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use automated tools, bots, or scripts to interact with the Service in a way that disrupts normal operation.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit any malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure.
• Resell, sublicense, or commercially exploit the Service or its content without written permission.

We reserve the right to suspend or terminate accounts that violate these provisions without refund.

All content, exercises, assessments, graphics, text, scoring algorithms, software, and other materials available through BrainSharp 50+ are the exclusive intellectual property of Timothy E. Parker and Advanced Learning Academy LLC, protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial cognitive training purposes. This license does not include the right to reproduce, distribute, modify, create derivative works from, or publicly display any content from the Service without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATIONS REGARDING THE EFFECTIVENESS OF BRAIN TRAINING FOR ANY PARTICULAR INDIVIDUAL. COGNITIVE RESULTS DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADVANCED LEARNING ACADEMY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Advanced Learning Academy LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Hamilton County, Indiana.

Before initiating any legal action, you agree to contact us at team@advancedlearning.academy to attempt good-faith resolution of the dispute.

We reserve the right to update these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last Updated" date and, where appropriate, by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, fraudulent activity, or any other reason at our sole discretion. Upon termination, your license to use the Service ceases immediately. Sections 6 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), and 10 (Governing Law) survive termination.
